Frank Reid called the meeting to order at 7:40

Others present Duane Ulrich, Pat Stempien, Robert Dano, Jeanne Dano, Jerry Britton, Jim Pitcher, Linda Ossont, and Attorney Todd McIntyre.
Robert Pratt led the Pledge.
The board tabled approval of the June minutes until the next meeting.
Attorney Report: Mr. McIntyre has prepared a letter to the Government stating that Ava has not sold any of the Ava test site property. This report is required yearly for three years after the purchase of the property. There was some discussion on the Right of Way (ROW) to the test site. While private owners own the land, Ava has the ROW across the property. Mr. McIntyre has also sent a letter to the OHSWA regarding the need for them to apply for the proper town permits to put in the landfill.
There was some discussion on the application fee schedule and the actual requirements for the application for use of wetlands and for the Landfill. Mr. McIntyre stated that the planning board or the town board could draw up an application and associated fee schedule. All requirements are in the law.
ACAL report: ACAL has filed an article 78 against the DEC commissioner, for issuance of the landfill permit.
Highway report: Andy Jackson is drawing up the blue prints for the storage building. The plans will be for a 40X60 freestanding steel building.
Planning Board report: There will be a public hearing on new subdivision requests on the West Ava Rd on August 10th 2004.
Public Forum: Mr. and Mrs. Dano would like speed limit signs on the Arab Hill road. There was a head on collision on the road and speed was a factor. Mr. Dano would like to have white signs for 10-15 mph. Mr. Dutch will contact the DOT in regards to getting speed limit signs. There should also be a stop or yield sign on the corner.
Mr. Britton wanted to know how Ava was going to enforce its local laws. He was wondering if OHSWA had indeed followed Ava’s laws and requested permit applications for use of the Wetlands and putting in a landfill. The DEC permit requires the OHSWA to acquire all local permits required by local laws. It was agreed that some board members should visit the site to see what construction is going since no permits have been applied for. Mr. Britton also suggested the board write to the DEC informing the commissioner that OHSWA is not complying with the stipulations set forth in the DEC permit regarding obtaining all local permits.
Linda Ossont the tax collector asked the board to consider purchasing a computer program for tax collectors. The program is $1500.00 and then it will cost $400.00 a year for license and updates. This way she will be able to keep permanent records in her office in order to look up tax information. Currently all tax rolls are returned to the County offices and all she has are her written notes.
David Mathis arrived at 8:20. Tom Tkachuk arrived at 8:25.
There was some discussion on new subdivision requests (on the west Ava Rd) to the planning board. Board members reviewed the land use and subdivision laws.
Beatrice Gookins is withdrawing from our retiree insurance plan.
On a motion by frank Reid and 2nd by James Ossont the board approved the general bills numbered 109-122 in the amount of $2724.07

On a motion by James Ossont and 2nd by Robert Pratt the board approved the Highway bills numbered 81-111 in the amount of $3116.00.

Robert Pratt noted that the Town clerk should have copies of all permits that have been issued.
OHSWA has not applied for any permits.
On a motion by Frank Reid and 2nd by Robert Pratt the board approved notifying the DEC commissioner that OHSWA is not in conformance with the permit issued by the DEC.
