END OF YEAR MEETING OF THE AVA TOWN BOARD

December 27, 2004

Supervisor David Mathis called the meeting to order at 7:42 p.m.

Those present were

Supervisor – David Mathis

Councilpersons – Robert Pratt, Alex Stempien, Frank Reid, James Ossont

Town Clerk – Sandra Richards

Highway Superintendent – Ken Dutch

Others present – Pat Stempien, Corey Mathis, Duane Ulrich, and Steve Hunter.

David Mathis led the Pledge

On a motion by Alex Stempien and 2nd by Frank Reid the November minutes were accepted as read.

There was some discussion on snow mobiling on the Ava Test site property. There are no groomed trails. If a club is interested in grooming trails, they must come to the Town Board and request permission.

Ken Dutch is interested in having a cover for the sand and gravel. There may be grants available through soil and water conservation. Steve Hunter will look into it.

The 2005 Organizational meeting will be held on January 3rd 2005 at 7:30.

There was some discussion on the Zoning and building permit list kept by the Town clerk. It was suggested that the clerk only include approved permits in the final list.

The ZBA will not meet again until April unless necessary.

The Planning board and ZBA meetings have been on the same evening. Duane Ulrich said it would be possible for the Planning board to meet on the 2nd Monday of the month.

NOCCOG has teamed up with SUNY-IT for workshops.

Mr. Reid called the parks committee regarding the letter Ava received about the $5,000.00 grant money left on the Town Hall. The town can only claim actual expenses. Mr. Reid submitted a bill in June of 1999, however it was denied at that time. Mr. Reid will reply with the information he has.

Robert Pratt will meet with Ray Meier on January 7th around 1pm. He will request some grant money for mining the test site, road improvements and highway equipment.

Mr. Pratt also suggested that since scrap prices are currently high, the Town should consider selling any scrap iron on the test site. Mr. Dutch also suggested trying to sell them on the Internet.

The Board reviewed the applications submitted for upcoming appointments.

On a motion by Frank Reid and 2nd by Robert Pratt the board approved the General bills numbered 202-238 in the amount of $11,702.83

On a motion by Robert Pratt and 2nd by James Ossont the board approved the Highway bills numbered 140-156 in the amount of $28,839.62

The Board discussed the subdivision request by Christmas and Assoc. There are 3 options the Board currently has.

  1. Change the Zoning law.
  2. Have Christmas and Assoc. apply for a Variance from the ZBA to allow frontage not on a public highway.
  3. Section 280a of Municipal states the Town Board may establish an ‘open area’ with referral and advice from the planning Board, whereupon they would provide the board with a list of stipulations.

On a motion by David Mathis and 2nd by James Ossont the board decided to refer the matter of an open area for the Nat Foster subdivision and Vary rd subdivision requests by Christmas and Associates to the Planning Board for its advice, conditions and limitations the open area should be subjected to.

A representative from Blue Cross and Blue Shield will come to the next meeting to meet with the Board and discuss Heath care plans.

On a motion by Robert Pratt and 2nd by James Ossont the board added an Agway bill for 694gals of diesel fuel in the amount of $817.95 to the Highway abstract to be paid.
